Estate Planning Pricing
At Learned Lawyer PLLC, we aim to provide our clients maximum peace of mind. Thus, we believe our pricing should be transparent and clear. For estate planning, we typically charge flat, all-inclusive fees, so that you can know what your estate plan will cost even before your first meeting. If you aren't sure which plan bets suits you, we will help you make that determination before any work begins.
Package 1 - Basic Will-based Plan
Cost: $650.00 single/$800.00 couple
About: This package includes advice and recommendations from attorney Scott Learned, and will result in the creation of custom Wills, Living Wills and Healthcare Powers of Attorney, and Financial Powers of Attorney.
Pros: This package will provide basic guidance to your loved ones as to who should wrap up your affairs following your death, and to whom they should distribute your property. The package will also provide guidance to your family about end-of-life issues, will appoint someone to make medical decisions if you are unable to do so, and will appoint someone to act for you to manage your finances if you cannot.
Cons: This package does not avoid probate proceedings, requiring your loved ones to go to court following your death. More importantly, this package cannot address more complicated estate planning needs. It will provide no protection for minor children, or for adult children who are not ready to inherit a large value of assets from you directly, whether due to disability, addiction problems, or immaturity.
This package leaves your wealth vulnerable to the "lottery winner" syndrome, and can easily result in your inheritance being squandered or, worse, providing the resources to allow a loved one to engage in self-destructive behaviors.
Finally, Package 1 affords you little protection in the event you become mentally disabled, and can leave your assets unprotected from unscrupulous people who wish to take advantage of you or require court proceedings to appoint a guardian and conservator for your estate.
Package 2 - Basic Will-based Plan with Community Property Deed
Cost: $850.00 single/$1000.00 couple
About: This package includes everything contained in Package 1, plus the creation of a community property deed.
Pros: In addition to the pros of Package 1, the additional deed in this package will, for some families, allow your loved ones to avoid probate, potentially saving thousands in legal fees after your death.
Cons: This package suffers from the same cons as Package 1, except that this package will allow some families to avoid probate.
Package 3 - Simple Trust-based Plan - BEST SELLER
Cost: $1500.00 single/$1800.00 couple
About: This package includes everything contained in Package 1, plus a custom-designed Revocable Living Trust and (if you have minor kids) a Temporary Guardianship Agreement. The package includes all advice and drafting costs, as well as funding assistance with your primary residence and other non-real estate assets, including bank, brokerage, and retirement accounts. Funding of real property in addition to your primary residence is an additional $100 per parcel.
Pros: This package includes all the benefits of Package 1. In addition, this package will allow your family to choose to avoid probate following your death, potentially saving thousands in court costs and fees. This package will provide protections for children or other beneficiaries who should not receive a large inheritance directly, including minor kids, or beneficiaries with addiction problems or immaturity issues.
This package will help your loved ones make intelligent decisions with their inheritance. With this package, your estate will be handled privately without the need for court interference. Package 3 will provide protection in the event you become mentally disabled, by designating a trusted person to manage all aspects of your finances without court intervention.
Cons: This package is not suitable for complicated family structures, like some blended families, or for families of significant wealth. It also may not be suitable for families with complicated assets, such as owners of small businesses, who will benefit from more advanced planning including buy-sell agreements. It is also not suitable for families with complicated distribution plans, such as plans involving multiple sub-trusts.
Package 4 - Advanced Trust-based Plan
Cost: starting at $2200 single/$2600 couple
About: This package includes everything contained in Package 3, plus any additional advanced estate planning documents. Examples include Irrevocable Life Insurance Trusts, Special Needs Trusts, Qualified Personal Residence Trusts, Buy-Sell Agreements, Family Limited Partnership, and Family LLCs. In addition, this package includes advanced revocable living trust planning to address the unique needs - and potential for conflict - inherent in some blended families. Finally, this package can address complicated distribution plans, or advanced tax planning needs.
